When you might need a lawyer or a doctor
Many claims never need either, beyond your own GP. Here's when extra help tends to matter.
Many claims never need a lawyer
Lodging a claim and statutory benefits are commonly managed without one. Legal help tends to matter when:
- The insurer denies your claim, or says you were mostly at fault
- Your injury is called a threshold injury and you disagree
- Your weekly payments or treatment are stopped or cut back
- You're thinking about a lump sum damages claim
- Someone died in the accident
- It's been more than 3 months since the accident
A doctor who knows CTP claims
You can keep seeing your own GP. You need a Certificate of Fitness from your treating doctor to lodge. A doctor experienced with CTP claims, or allied health, can help when:
- You don't have a regular GP to see
- You need a Certificate of Fitness to lodge, or to keep it current
- You need ongoing treatment, such as physiotherapy or psychology
The CTP insurer generally pays for treatment that is reasonable and necessary for your accident injuries. It decides what's approved, and its decisions can be reviewed.

What help do I need?The dates that matter
Most time limits run from the date of the accident. Review time limits run from when you receive the insurer's decision. Acting early keeps your options open.

To get weekly payments back-paid
To get weekly payments back-paid to the day after the accident, the insurer generally needs your claim within 28 days of the accident.
- 3 months
To make your claim
You can still claim up to 3 months after the accident, but weekly payments may only start from the date of your claim. Later claims are accepted only in limited circumstances.

To ask for a review
If you disagree with most insurer decisions, you can generally ask the insurer for an internal review within 28 days of receiving the decision.

For a damages claim
A common law damages claim must generally be made within 3 years of the accident.
What a CTP claim can cover
Most people hurt in a NSW motor accident can claim statutory benefits, whoever was at fault. Some can also claim a lump sum.
Treatment and care
Reasonable and necessary medical, dental, pharmaceutical and rehabilitation costs, travel to and from treatment, and paid help at home or personal care if you need it while you recover.

If you can't work, or can't work as much: up to 95% of your pre-accident earnings for the first 13 weeks, then up to 80% or 85% from week 14, depending on your earning capacity. A maximum weekly amount applies. Self-employed people can claim too.
Weekly paymentsLump sum damages, for some
You may be able to claim common law damages if another driver was at fault and your injury is more than a threshold injury. Damages for pain and suffering need a whole person impairment of more than 10%.
Lump sum damagesAfter a death
Reasonable funeral expenses are covered regardless of fault. Close relatives who were financially dependent on the person may be able to claim compensation.
Help for families
If you were wholly or mostly at fault, or your injury is a threshold injury, statutory benefits generally stop after 52 weeks (for accidents from 1 April 2023). Children who were 16 or under at the time of the accident can get treatment and care for as long as they need it, regardless of fault. CTP covers injuries, not damage to vehicles.

A Certificate of Fitness from your doctor
The police event number (report the crash on 131 444)
Details of the crash and the vehicles involved, including number plates
Hospital or ambulance details, if you have them
Details of any earlier injury to the same part of your body
Proof of earnings, such as payslips, if you're claiming lost income
Lodging online needs a MyServiceNSW account. Bank and Medicare details go on the claim form only, never to us.
